Terms of service

What Kreativ is

Kreativ is a website builder and archive for visual artists. You upload your works and content, you design a site from a template, and we publish and host that site on a Kreativ subdomain or on a domain you connect.

The service is offered as it stands. We add and improve things continuously, and we may change or retire a feature — but not one you actively depend on, without telling you in advance.

Your account

Kreativ is currently invite-only. Your account is personal: keep your password to yourself and let us know promptly if you think someone else has access.

You must be at least 16 years old, and the details you give us must be accurate. You are responsible for what happens under your account.

Your content stays yours

You keep every right in the works, images, text and other material you upload. Nothing here transfers ownership, and we do not claim a licence to use your work for our own promotion.

You grant us only the narrow, revocable permission needed to run the service: to store your content, to process it technically (resizing an image, generating a preview) and to display it on the website we publish for you. That permission ends when you delete the content or your account.

You confirm that you hold the rights to what you upload — including any photographs of your work taken by someone else — and that publishing it breaks no third party's rights.

Acceptable use

Using Kreativ, you agree not to:

• Publish anything unlawful, or anything that infringes someone else's copyright, trademark or privacy.
• Send unsolicited bulk email from the platform, or mail people who never agreed to hear from you.
• Attempt to access another account's data, or to probe, scan or disrupt the service.
• Resell or rebrand the service as your own without a written agreement.
• Upload malware, or use the file storage as a general-purpose file host unrelated to your practice.

Email and your audience

When you send campaigns through Kreativ you are the sender. You are responsible for having a lawful basis to email each recipient and for honouring every unsubscribe.

Every campaign we send carries a working unsubscribe link, and we will not remove it. If we receive credible spam complaints about your account, we may pause its sending ability while we look into it.

Availability

We work to keep Kreativ and the sites we publish available, but we do not promise uninterrupted service. Maintenance, third-party outages and faults happen.

We announce planned maintenance in advance where we can, and we schedule it outside European working hours where the work allows.

Payment

Kreativ is free during early access. If we introduce paid plans, we will tell you well in advance, and no account is ever converted to a paid plan without your explicit agreement.

Where a connected domain is bought through us, the registration fee is charged separately and follows the registry's own terms.

Ending the agreement

You can leave at any time. Settings → Account deletes your account and everything in it: the site goes offline at once, and after 30 days the data is permanently erased. You can cancel within that window, or erase everything immediately if you prefer.

We may suspend or close an account that breaks these terms. Except where the breach is serious or unlawful, we will warn you first and give you a fair chance to put it right. If we close your account without cause, we will give you reasonable notice and a way to export your content.

Liability

Nothing in these terms limits liability for intent, gross negligence, death or personal injury, or anything else that cannot lawfully be limited.

Beyond that, our liability is limited to the amount you paid us in the twelve months before the event, and we are not liable for indirect or consequential loss such as lost sales or lost opportunities.

Keep your own copies of your work. We take backups, but a backup on our side is not a substitute for your own archive, and you should not rely on Kreativ as your only copy.

Governing law

These terms are governed by the law of the Netherlands. Disputes go to the competent court in the Netherlands, without prejudice to any mandatory consumer protection you enjoy where you live.

Changes to these terms

We may update these terms as the product changes. Material changes are announced by email at least thirty days before they take effect, and if you do not accept them you can close your account before that date.
